On December 11, 2019, the Indiana Court of Appeals heard oral argument in City of Fort Wayne v. Southwest Allen County Fire Protection District. James P. Fenton and Timothy A. Manges of Fletcher Van Gilder LLP represented the City of Fort Wayne.
The case involves areas in the Fire District that were annexed by Fort Wayne. The City now provides fire protection services to the areas, and therefore claims a right to certain tax revenues. On February 7, 2019, the Allen Superior Court granted summary judgment for the City, finding that the annexed areas ceased to be part of the Fire District. As a result, the City is entitled to receive property tax revenues attributable to fire protection services in those areas. The Fire District is appealing.
